Gilead Sciences, Inc. v. Pain Relief Rx, et al

On May 1, 2026, The U.S. District Court in the Eastern District of New York unsealed an April 2026 civil complaint filed by Gilead Sciences against ten pharmacies and 15 individuals alleged to have sold diverted HIV/AIDS medicines on online pharmacy-to-pharmacy marketplaces.

As with the civl case it filed against Safe Chain Solutions and related defendants in 2022, Gilead seeks to shut down the trade of these medicines, which are of unknown quality, through the Lanham Act, which governs U.S. trademark law.

The evidence for this case was chiefly gathered by a cooperating pharmacist who purchased suspect products listed on four pharmacy marketplaces between December 2025 and March 2026.
