Eli Lilly v InstantRx, et al
In June 2026, Eli Lilly filed a civil complaint in the U.S. District Court in the Eastern District of New York alleging that 19 defendants, including five pharmacies, had sold diverted Trulicity and Mounjaro, diabetes treatments, on online pharmacy-to-pharmacy marketplaces.
Lilly seeks to shut down the trade of these medicines, which are of unknown quality, through the Lanham Act, which governs U.S. trademark law.
The evidence for this case was chiefly gathered by a cooperating pharmacist who purchased suspect products listed on pharmacy marketplaces between July and November 2026.
